Savin Martinet Associés has followed every single step of the negotiations which led to the adoption of the REACH regulation on chemical substances, which came into force on the territory of the European Union on June 1, 2007.
Through this new set of rules, Europe has adopted an ambitious regulation to “ensure a high level of protection of human health and the environment (…) the free circulation of substances (…) while enhancing competitiveness and innovation” (Article 1 of the Regulation), of which the Savin Martinet Associate law firm has a deep knowledge.
Its long and recognized experience in the fields of health and safety law and environmental law enables the firm to assist and advise the manufacturers and importers who must pre-register, from June 1, 2008 to December 1, 2008, the “existing” substances manufactured or imported in the Community in quantities totalling over one tonne per year, to register, subject to the payment of a fee, the substances by submitting a technical dossier including in particular the (eco)toxicological data and a chemical safety report covering the whole life cycle of the substance, and to ensure the communication of information to their clients on the intrinsic properties of the substances and the recommended measures for risk management, using in particular material safety data sheets (MSDS).
The Firm also assists downstream users who have the obligation to identify, implement and, as the case may be, recommend to their own clients the measures recommended by their suppliers to ensure the control of the risks and, before registration, to inform, via their supplier, the manufacturers or importers in order for them to take into account their uses and integrate them in the exposure scenarii included in the registration dossier and the MSDS.
In order to correctly address these transversal problems, the Savin Martinet Associés law firm has added the expertise of Dr. Patrick Lévy (PLC), advisor doctor of the Chemical Industries Union, on technical issues, of Itecor regarding the implementation of specific information systems, of the CIT laboratory for analyses, as well as the expertise of Marsh regarding insurance issues related to these new risks (supply chain disruption, increased product civil liability, product recall process…).
